Good morning one and all

 

"Thank you" is putting it oh so mildly for all the kind expressions of support.  I am apprehensive of the phone call from the insurance company for my not-so-inner cynic tells me that insurance covers everything except what happens.  I could not really settle to anything yesterday but there is still plenty to do, car or no car.  I just don't feel like doing it!  One daft idea that entered my head was how to get to Swindon to fetch the wretched vehicle in due course.  How about X5 "express" bus from Bedford to Oxford [2h30m], changing to route 66 from Oxford to Swindon [1h30m]?  I have a bus pass.  Hmmm ...

 

I normally do some sort of forward look on Mondays so here goes.  Today I am not now having lunch with a friend.  I will make it up to him later, even though the discount voucher which prompted the idea will have expired.  Tuesday will see a fodder run, as will Friday and possibly also Wednesday depending on how long the list becomes.  Thursday should be lunch with Poorly Pal and if by some miracle I have a courtesy car available by then it might just happen.  Walk on, walk on, with hope in your heart.

 

Fondest thoughts to all who have their troubles, whether or not they share them with others.  Knowing whether or not to do so is not always easy.and I apologise if I have got it wrong.

Hmmm -  I wonder where the weekend went?  One minute it was Friday, now it's Monday!

 

It is very cold this morning, and I mean cold.  -12°C is the current temperature, but it should get warmer once it gets light.

Sorry to hear of your misfortune, ChrisF; hope the insurance company does not live up to your cynicism.

 

Came across the phrase 'without prejudice' last week, although was already aware of 'without obligation'. Although I have gleaned a bit from the interwhotsit, can any of our legal contributors suggest how and when they should be used and if they can be combined, please? Begs the question 'are there any more'?

The trouble with insurance these days is they are geared up to hire cars at overblown prices when they can claim it on the other persons insurance. The deer obviously has no insurance. When someone reversed into me ( I was stopped behind them and wanting to get into a parking slot they just reversed back) I was immediately offered a hire car however the company that organised it wanted me to collect it from Southampton or Portsmouth  which would have involved four ferry trips at my expense. Fortunately the garage they selected agreed to provide me with a courtesy car.

You may be falling foul of a similar problem. They do see a chance to extort extra money for the car hire.

Morning all.

 

Cynical or not insurance companies are obliged to offer the cover stated in the policy provided payment is up to date.  If you pay by the month and your vehicle is declared a total loss be aware that any outstanding premium will be deducted before a settlement is paid.  As will any applicable excess in all cases.

 

There are situations in which this can result in you owing the insurer money.  This would arise for a low-value car declared a total loss with a large proportion of premium outstanding.  The premium can exceed the value of the car particularly for young drivers who can often only afford the cheapest cars available.

 

If your policy includes a hire car for the event then one must be offered.  Most policies offer it as standard for theft but only as an option for other events.  The insurer might have a fixed price deal with the hirer (they usually use one of the international big boys at mates rates) which might involve a small additional fee being paid by the insured party to "rent" it here, leave it there as the business deal doesn't include that.  But the one-way fee is often less than a train fare from A to B to recover your own vehicle.  

 

Some insurers / roadside service providers also offer additional cover if your vehicle was disabled more than a specified distance from home.  In Australia that is over 100kms; it may be worth checking what is covered in the UK.

 

Point of order re: collisions with creatures.  If you and an animal or bird are in collision and the latter dies you are not permitted to claim it for yourself as roadkill; that constitutes poaching under UK law.  Anyone else following along can take it however so if you're after a brace of pheasant go out in two cars.  One to knock the birds senseless as they fly up and the other to retrieve and bag them!

 

It's been a day.  Some wash-up from Friday's events.  The Bourke Street mall has reopened and is a sea of floral tributes with an official public memorial established at the General Post Office building.  A vigil is to be held led by the State premier, Daniel Andrews, who is already copping a good deal of backlash.  Anger is natural arising from shock and grief.  But serious questions are being asked of our justice and policing systems which are all under the Premier's ultimate control.  Why was a known dangerous man allowed to run when he could have been more safely taken out at home in the suburbs on existing warrants?  Why was a massive police chase into and through the city allowed to continue instead of being called off as too dangerous?  Why was this chap even on bail given his violent past and criminal record?????

 

In more trivial matters tonight's supermarket run was briefly interrupted by post-3305-0-94608800-1485157117.png driving normally but with hazard lights flashing.  The reason for the hazards became clear when said cockerel womble turned right onto then left from a main road without adjusting the signals nearly causing a multiple-vehicle incident.  Instead the driver continued before stopping astride the white centre lines and exiting the vehicle to go shopping :O

 

I understand that the ossifers of the lore have been called for.

I am not a legal chappie but I think without prejudice is used when an action could imply acceptance of some liability and the insurance company are stating that taking that action would not be prejudicial to any claim by any party. With obligation is stating that taking an action does not commit them to any further action. I would assume you could say 'without prejudice or obligation' to cover both. But in a situation where such words are deemed necessary expert guidance might be needed. 

I suppose a  example might be a company agreeing to inspect an item when you are making a claim that it was faulty. Their examination might be without prejudice i.e by examining the item they are not accepting that there is any fault or liability for one should it be found.

Spot on.

 

An insurer may make an offer to part or fully settle any claim "without prejudice" to their own position on the matter including but not limited to a determination of liability.

Morning all and its -3oC and foggy.

Sorry to hear of Chris' troubles and hope that the insurance comes up trumps. 

 

Rick, your point about poaching reminds me of an anecdote told to me some years ago. 

A chap who'd originally trained as a butcher was driving along one evening hurrying to his daughter's school concert. 

A deer raced out in front of him and that was the end of the deer. 

Recognising that there were a fair few venison cuts on the carcass, but running short of time, he hefted the deer up and in some kind of manly "deer-hug" hauled it off to the undergrowth for later retrieval and butchery. 

20 minutes later he entered the school concert haul - the white office shirt he was wearing was liberally smeared in blood to the collective gasps of other parents!   :butcher:

 

Something similar happened to swmbo years ago. A deer hit her Mini Cooper with all 4 legs* coming through the windscreen. Neither the Mini nor the deer survived the encounter. 

* the deer's, not swmbo's, who famously only has 2 legs.  :yes:

 

Apropos my washing machine/tumble dryer - and I may be speaking too soon - the internet diagnosis for it not draining on tumble dry mode indicated that condensate was failing to drain due to excess fluff in a manifold attached to the fan unit. Disassembly was indicated. 

However, as a random thought I tried a heavy dose of anti-scale tablets yesterday at 95oC and, for whatever reason, the fault has disappeared. Maybe the limescale was fluffy?!  :dontknow:

 

The weekend saw a small amount of work on the layout. Although in rooting around for some material to make a fence I stumbled across a red London bus.

So, that 's the bridge scene sorted!   :mosking:

Morning all from Estuary-Land. I thought the sun was burning the fog off nicely earlier this morning but the fog staged a rearguard action and has now fought it off. When I had to get my car repaired last year after another driver pulled out into the side the insurance company handed it over to a specialist company that collected my car, repaired it and returned it as well as delivering and collecting the hire car. I found on reading the paperwork that the company was part of the Hertz organisation.

 

We're replacing a builtin wardrobe in a bedroom, plus doing a general "de-cluttering" of the whole house. (Hint - do not try these things at the same time.) It's turned up many of those "So that's where that went!" moments. Amongst them was the discovery of a bag of mostly UK currency. Nothing of any great denomination, but some interesting stuff. So far a quick scan has produced a 10 shilling note, several 12 (?) sided thrupenny bits, quite a few Victoria pennies, a few silver thrupenny bits (my gran used to put them in 'clootie' dumplings made as birthday cakes) a couple of crowns and a Greenock and Port Glasgow Tramway Company fare token. When we have time, we'll do a more detailed examination.

Its surprising what you can find when buying/modifying a house.

Morning awl, slightly late, from the mythical village just off the M62.   I have something very very serious to report.  The Beeb has been making great play about the shortage of courgettes in the land of the twitterati.   I can now report that there is a complete lack of Eccles cakes in Asda, Morley.  Surely this is the end of civilisation as we know it.

 

Anyway up early and off to Asda (see above), I had to do the shopping as  Beth is off on a Warner's week with some girlfriends.  Thus I was doing my own shopping for the coming week and certain items were obviously to be bought, or so I thought. 

 

Now it's off to darling daughter's to put up a knife rack.

Morning awl,

A reasonable nights sleep was had, about 6 hours in three pieces.

 

This morning, was nowhere near as cold as the day before the frost on the windscreen was soft enough for the wiper blades to remove. No fog was seen on the way in either...

I saw one deer and one pheasant  on the way in to work today, both decided, not to take the car on and ran / flew away.

A happy birthday greeting seems to be in order for Mick.

 

As far as 'without prejudice' is concerned the meaning is very simple as it boils down to 'this payment does not set a precedent for a similar payment or acknowledgement of responsibility in the future.  Originally the term seems to have been used with a further qualification such as 'without prejudice to any future claim' etc; I occasionally used it when allowing claims for loss of earnings where there was what one might call 'natural justice' but the claim did not comply with anything laid down in the conditions of service and it can also be rather handy in contracts.

 

Another delightfully frosty morning without too much fist & mog here although 'Little Russia On The Hill' across the valley remains invisible but the Fog Object is in view so normal working is in order.

Ian you continue to say what you believe in. When it seemed my comment had offended you I said I was sorry.  Surely we can talk about serious things on here without falling out. Both the issue of the treatment of women and the acceptance of democratic processes are important. I agree that party politics should be avoided but life involves some politics so many of the things mentioned on here have a political side to them.

I must admit the US choices of President have picked some odd ones Nixon, Clinton, W Bush, Trump not your finest I think but I dont know of a better system. What I do feel it to give the American people a choice between just Hilary Clinton and Trump is not a good start. I would be looking for none of the above on a ballot paper. Not that our system is much better where a  the government can be changed by the voters in a small number of seats and voters in so called safe seats can feel cheated of any real say in the election. Our local MP is known as 'Idle Stranger' which shows something of how represented we feel.

Anyway enough of all that. Don't get started on Gauges I remember all the fuss about 00/EM/P4 in the end I opted for other scales. I enjoy hearing about your modelling, the weather you get you daughters flying and commiserate about the problems at work seems a good basis to me.

Tumble dryer update - I know Pete will be soothed by the heady pace - I can get the thing to work for drying times of ~20 minutes, but it fails if I dial in 35 minutes. 

I believe tumble dryers fail most often when people "interrupt" a cycle to see if their clothes are dry without letting the machine finish whatever its doing "properly".

 

I'm also watching some high-tack glue bond scatter to some foam board.

 

This is all for a purpose. To make the next chapter of Prince2 fly by! :)

 

Youngest is sheltering under his duvet watching a film. I diagnosed a severe case of Mondayitus, possibly with Spellingtestitis. But it seems genuine, confounding my medical knowledge, as he keeps drifting off to sleep.

There is a travel app Moovit which helps you plan travel. Unfortunately I cannot find Bedford on it. Either Bedford has vanished overnight and a large meteorite or meteor crater now exists there or there is a glitch in the system.

ChrisF - Late to the “do” but sorry to hear of your incident. Deer strikes are a big problem around here. We have more wooded areas than at any time back to the time of the first railroads - when they started to be  heavily “harvested” for railroad ties.

 

We have zero instances of Sasquatch strikes. That would come under the heading of “alternate facts”......(despite the show having been here twice).

 

On duty this am at another local intersection - under a “Nor’easter” warning of high winds and heavy rains, Oh, joy. Still, it could be worse - no snow.
